The agreement

These terms are between you and SideKit, Inc., 6th Floor, 136 Madison Ave, New York, New York, who make Island: Screen Time. Where they say we, they mean that company, and where they say the app, they mean the app and this website together. Using the app means you accept them. If you do not, the remedy is to stop using it.

You need to be at least 16 to use the app.

What the app is

The app is a game that responds to how much time you spend in apps you choose. It is entertainment, and a nudge. It is not medical advice, not a treatment for anything, and not a substitute for professional help. If your relationship with your phone is causing you real harm, please talk to someone qualified.

The app does not block anything by default. If you turn on the wall, the app will try to stand it in front of a tracked app once you are past your limit, but it depends on features your operating system controls and permissions you can revoke. Treat it as a help, not a guarantee.

Screen time figures are estimates

The app reads your usage through the tools each operating system provides, and those tools differ. On iOS the figures arrive as thresholds and are rounded down, so what you see is a floor rather than an exact total, and it can sit still for a while after you change your app selection. Do not rely on the numbers as a precise record.

Your account

You may use the app without an account. If you make one, keep control of the phone number behind it, since anyone who can receive its codes can reach your account. Tell us if you think someone else has got in.

Your handle is visible to people you add as friends. Choose one you are happy for them to see, and do not impersonate anyone. We may reclaim a handle that impersonates someone or that we are required to remove.

You can delete your account at any time from within the app, which erases your data as described in the Privacy Policy. We may suspend or close an account that is being used to abuse other people, to break these terms, or to attack the service.

Friends and visiting

Adding a friend lets them see your island, your daily total against your own limit, and your streak. You are choosing to share that when you accept a request, so add people you are happy to show it to. Do not use the friends features to harass anyone.

Fair use

Please do not:

• Break, reverse engineer, or work around the app in order to falsify your usage or your standing against other players.
• Use the app's servers other than through the app itself, or in a way that degrades them for anyone else.
• Use the app for anything unlawful.

What the app costs

The app is currently free, and there is nothing to buy inside it.

What belongs to whom

The app, its art, and its writing are ours, and you get a personal, non-transferable licence to use the app for as long as you follow these terms. Your island, and the choices you make on it, are yours.

Availability

We will do our best to keep the service up, but we do not promise it will always be available or free of faults, and we may change or withdraw features. If we discontinue the service, we will give reasonable notice in the app so you can get your data out.

Liability

The app is provided as it is. To the extent the law allows, we make no promises about it beyond the ones written here, and we are not liable for anything you lose by relying on it, including any decision you make about your own time or attention on the strength of the figures it shows.

We are not liable for indirect or consequential loss, or for lost profits, lost data, or lost goodwill, whether or not we knew that such a loss was possible. Where we are liable, our total liability for everything connected with the app is limited to the greater of one hundred US dollars and whatever you have paid us in the twelve months before the claim.

Nothing here limits liability that cannot be limited by law, and if you are a consumer, your legal rights stand whatever this document says.

Changes

We may update these terms. If a change matters, we will say so in the app before it takes effect. Continuing to use the app after that means you accept the new version.

Governing law

We are incorporated in Delaware and registered to do business in New York, which is where we work. These terms are governed by the law of the State of New York, and a dispute that reaches a court belongs in the state or federal courts sitting in New York County, New York.

If you are a consumer, that sentence takes nothing away from you. You keep whatever protections the law where you live does not let you sign away, and where that law gives you the right to bring a claim in your own local courts, you keep that too. This is the position across the UK and the EU in particular.
